the lever is free the set screw rests on the gold button , the gold button is under spring pressure . so the set screw is holding the brake lever out and pushing in the brake switch (white button) . so turning the set screw clock wise toward the gold will hold the lever out more , remember every time you move the set screw you will change the way the brake grabs (keep that in mind) .

Thanks Alley , I got a phone call yesterday about this and did not know for sure . The part that puzzled me was at idle it did not leak . I thought that it would leak all the time the bowl is over full .

it is happening with back firing on the intake . Performance cdi I'm guessing with fixed advanced timing . I suggested testing with stock cdi . no change .
I imagine the fuel is sucked via vacuum , so how could it be pouring out of the air filter .

Ok on the brake handle there it a stop/set screw with a jam nut . Loosen the jam nut turn the set screw clock wise 3 or 4 turns . Tighten the jam nut and see if that solved the problem . You can play around with the set screw to align with the button .

Deb can you post a picture of the brake switch that you replaced depending the style one you have it could have been for the other side . your welcome to text a picture to me and I can post it for for you .
Now you say your brake light is lit all the time , do you have to hold the brake to start the engine ? what if you just hit the starter button .
Alley's posts above I agree with 100% don't dismiss them . He posted a picture of one style of brake switch .

Duh. This is a new scooter for us and we haven't driven it in a while. Didn't realize you need to hold the left brake in order to start. Thank goodness for the internet. Starts fine now that we know that. NEW PROBLEM, though. Brake light stays on even though switch was replaced. If we hold right brake handle up (NOT out/disengaged, but literally up) the brake light goes out. So what is the problem?
You might want to humble yourself when asking for help . New scooter bad brake switch , so you replaced it (could your new one be defective) . The duh question , your electric start only gets power when the brake light gets power . the short answer might be a loose nut behind the wheel , welcome to the forum !!!!!!!!!!!!!! John
