Is it ok to fill the gear oil to the top allowing for any excess to drain back into  pan. |

No the gearbox will blow oil forever out the air vent. Per the YY250P manual the gearbox holds about 6-1/2 ounces of gear oil. I put 7 ounces in. Also most a cup full.

Also look on the Case of the CVT by the rear Wheel it should have it stamped on it the capacity.
