Well after lots of trouble shooting I found it was my main jet was too big. The scooter was running way lean and went up two sizes from what I thought was in there (which had no markings). I should have measured the orifice with a drill bit and compared to the jet kit I bought. Well the original was likely 110. Two sizes up from 110, is 1st is 115 and 2nd is 120.
Well I took the 120 out and put in 110... after verifying the original was 108.
Now before you say OF COURSE... Right after the jet change it RAN FINE with the 120. The high speed miss came later. I may have also had a spark plug issue. It was clear the plug was getting fouled. However unrelated and may be bad luck the plug may have developed a defect (meaning a crack in porcelain not visible or internal conductor break). I measured the plug and go zero continuity.
New 110 jet installed (one size up from original) and replaced plug and it runs perfect.

My money goes to an electrical issue in the harness,,,especially since you said you had a problem when you turned the bars Yep I think you are right, but I dread this kind of electrical problem. It is not a short, it is not open, but a partial open where not enough current can supply the ignition. Thanks for the reply cyborg

I have missing, like ignition is being turned off then on above 37 mph (like clock work). I can continue to accelerate to 42 where it tops out, cutting in and out. Before this it would run up to 52 mph with no missing...
HISTORY: Got my scooter several months ago. All was good. OEM battery died and fixed that with sealed AGM. Then had weird electrical issue, could not start with handle bars turned left. It was the wire routing under the fairing when turned the brake line pulled on the wiring. Fixed that. OTHER issue lean lean lean white plug. I upped the main and intermediate jet. Now I get light brown porcelain. The bike continued to run smooth to 52. I was disappointed I did not get more speed.
I have since (after the problem appeared) removed the "emission" and vacuum petcock. It came out nice, but did not fix the issue.
I checked plug gap again. Any ideas? I am thinking a vacuum leak or ignition issue. It is possible the problem under the fairing I fixed was not 100% and some wires are almost open, enough to work but limits current to ignition? Should I buy a new CDI, Coil and PLUG... a set on eBay is cheap... about $10.
PS the scooter is running GOOD otherwise. It starts, idles nice, has great low speed acceleration, it just cuts in and out at 37 mph.
