I recently bought a road runner scooter and I went to shell gas station filled up got home went out next morning now won't start is getting spark was wondering if it would be bad gas

How many miles on the scoot is it new or used? Maybe you overfilled the tank and If it has a EVAP system which has charcoal canister to trap the gas tank fumes, gas may have gotten into the vent hose and is not venting. So crack the gas cap open and see if it is a fuel delivery problem.
If it has some miles on the scoot first thing would be to adjust the valves to .004 inchs both of them.
